• The individual developer and our relevant affiliates are referred to as "Developer", "we", "us", and "our."
• Our mobile application Aiwiggle is referred to as "Aiwiggle" or "application"
• Users are referred to as "users", "you" or "your", as applicable.
• Your use of the applications (including downloading, installing, registering with, accessing, or otherwise using it) is referred to as "Use".
• To the extent information is: (i) associated with an identified or identifiable natural person and (ii) protected as personal data under applicable data protection laws, such information is referred to in this Privacy Policy as "Personal Data".

A note on how the AI Video feature works and how we use uploaded Face Data

Aiwiggle uses advanced AI video generation technology that allows users to generate personalized anime-style videos from their photos.

1. Users upload a photo. For best results and expected experience, we recommend uploading a full-body front-facing photo.
2. Users select a video template with desired movements and scenes
3. Using this photo data and the selected video template, our AI model generates an anime-style video where your character appears to move in real-world scenarios
4. After the video is generated, the uploaded original photos are deleted permanently from our self-hosted servers
5. We do not use your Personal Data to generally train and/or create our separate artificial intelligence/products.

We do our best to moderate the parameters of our AI model, however, it is still possible that you may encounter content that you may see as inappropriate for you.

We also encourage you to get acquainted with our Terms of Use to understand how we provide services to you.

We respect your privacy and are committed to protecting it through our compliance with this Privacy Policy. This Privacy Policy explains what we do with your Personal Data (as defined below) and allows you to manage your Personal Data effectively.

Please read this Privacy Policy carefully to understand our privacy practices. The purpose of our Privacy Policy is to explain what data we collect, how it is used and shared, and how you can control it. If you do not want us to process your Personal Data as it is described in this Privacy Policy, please do not Use Aiwiggle.

By Using Aiwiggle, you understand and agree that we are providing you with tools for generating anime-style videos from photos that you upload, for example with our AI Video feature.

This Privacy Policy DOES NOT apply to the information that:

• We collect offline or on any of our other apps or websites, including websites you may access to through Aiwiggle.
• You provide to or that is collected by any third party (e.g., any third-party application or website, even if the link to it is accessible through Aiwiggle).

1. INFORMATION WE COLLECT AND HOW WE COLLECT IT

We may collect several types of information, including but not limited to Personal Data, from and about you:

• Directly from you when you provide it to us.
• From Apple when you sign in with your Apple ID.

2. INFORMATION YOU PROVIDE TO US DIRECTLY

When you Use Aiwiggle, you usually provide to us certain information, including your Personal Data:

Photos that you upload to Aiwiggle, for example to use the AI Video feature. Please note that we always delete all metadata that may be associated with your photos by default (including, for example, geotags) before temporarily storing them to our systems.

We can access your photos only after you grant us permission to access your devices' photo library. You provide such a permission through the request that appears on your mobile device (it may differ depending on your device operating system). You may revoke permission to access your photo library through the settings on your mobile device, and here's how to do it.

If you use an iOS device:

1. On your iPhone or iPad open the Settings app.
2. Scroll down and tap "Privacy & Security".
3. Tap "Photos".
4. Next to Aiwiggle, toggle the permissions switching on or off.

Your email and user profile information: When you create an account with Sign in with Apple, we receive your email (or Apple's private relay email) that will be further used for your sign-in process and account identification. We may also store a profile picture if you choose to set one in the app.

If you contact us, records, copies of your correspondence with us and contact details that you have provided us while making your inquiries (such as your name, email addresses or any other identifier by which you may be contacted online or offline), in order to investigate your concerns, respond to your inquiries and to monitor and improve our responses to your and other users inquiries in relation to Aiwiggle.

3. INFORMATION WE COLLECT AUTOMATICALLY

Currently, Aiwiggle does not automatically collect device information, IP addresses, operating system details, or network information. We do not use third-party analytics tools, advertising services, or tracking technologies.

We only store information necessary for the operation of your account and services, which includes:

Details about your in-app purchases and virtual currency balance. This data is used to provide you with the Services, including tracking your diamond/gem balance used for video generation. This information is stored on our self-hosted servers only.

4. HOW WE PROCESS YOUR PHOTOS AND VIDEOS

We care about your privacy.

AI Video Generation: In order to generate personalized anime-style videos, you have to upload a photo to Aiwiggle. At this point, your photo is stored on our secure servers located in the United States. Our self-hosted AI model then processes your photo with the selected video template to generate the anime-style video. Immediately after the successful generation of the video, your original uploaded photo is deleted from our servers.

Your generated videos are stored on our servers so that they remain accessible to you in Aiwiggle at any time and from any device until you decide to delete them or delete your account.

You can also always request us to delete your photos or generated videos by contacting us at [email protected].

Notwithstanding anything to the contrary elsewhere in this Privacy Policy:

• We do not use photos or generated videos to identify any individual user.
• We do not use your photos or generated videos for authentication, advertising, or marketing purposes, or to otherwise target a user in a similar manner.
• We do not use your photos or generated videos to build a user profile, or otherwise attempt, facilitate, or encourage third parties to identify anonymous users or reconstruct user profiles based on your photos or generated videos.
• We do not transfer, share, sell, or otherwise provide your photos or generated videos to advertising platforms, analytics providers, data brokers, information resellers or other such parties.

5. THE PURPOSES AND OUR LEGAL BASES FOR PROCESSING YOUR PERSONAL DATA

We use your information other than photos and videos for the following purposes:

• To carry out our obligations and enforce our rights arising from any contracts entered into between you and us in relation to Aiwiggle (e.g., the Terms of Use).
• To provide you with support and to respond to your inquiries.
• To notify you about changes to Aiwiggle or any products or services we offer.
• To present to you and others with Aiwiggle and its contents and any other information, products or services that you request from us.
• To monitor aggregated metrics such as total number of users, traffic, and demographic patterns.
• To provide, improve, test, and monitor the effectiveness of Aiwiggle in an aggregated manner.
• To provide necessary service notifications related to Aiwiggle.
• In any other way, as described in this Privacy Policy.

As a developer based in France, we comply with the General Data Protection Regulation (GDPR). Our legal bases for processing your personal data are:

• Contract: Processing is necessary for the performance of a contract with you (e.g., providing the video generation service)
• Consent: Processing is based on your consent (e.g., marketing communications)
• Legitimate interests: Processing is necessary for our legitimate interests (e.g., improving our service, fraud prevention)
• Legal obligation: Processing is necessary for compliance with a legal obligation

6. YOUR RIGHTS

Access, modification, correction and erasure: You can send us an email at [email protected] to request access to, modification, correction, update, erasure or portability of any Personal Data that you have provided to us and that we have about you. You also have the option to delete your account directly within the app through the Settings page.

EEA/UK/France residents: Individuals residing in the European Economic Area ("EEA"), the United Kingdom ("UK"), and France have certain statutory rights in relation to their Personal Data under the GDPR. These rights include:

• Right to access your personal data
• Right to rectification of inaccurate personal data
• Right to erasure ("right to be forgotten")
• Right to restrict processing
• Right to data portability
• Right to object to processing
• Right to withdraw consent
• Right to lodge a complaint with a supervisory authority (CNIL in France)

California, Virginia, Colorado, Utah, and Connecticut residents may have statutory rights under state comprehensive privacy laws, including rights to access, delete, and opt-out of sale of personal data.

We do not sell your personal data to third parties.

7. SHARING OF COLLECTED INFORMATION

We do not rent or sell your Personal Data, including photos and videos, to any third parties.

All our services are self-hosted on our own servers, including our AI video generation service. We do not share your personal data with third-party analytics providers, advertising networks, or other external service providers.

In-app purchases are processed by Apple through the App Store, and your payment information is handled directly by Apple according to their privacy policy. We do not receive or store any payment card details.

8. DATA SECURITY

We use reasonable and appropriate information security safeguards to help keep the collected information secure and to secure it from accidental loss and unauthorized access, use, alteration and disclosure. All our services, including AI processing, run on our self-hosted services on secure servers located in the United States. Your data is stored on our secure servers with encryption in transit. However, please be aware that no method of transmission over the Internet or electronic storage is 100% secure.

9. DATA RETENTION

Your Personal Data, other than photos and videos: We will retain your Personal Data until you delete your account or request us to delete your data. After account deletion, we may retain certain data for legal, accounting, or tax purposes as required by applicable laws.

Your original photos that you upload to generate videos are deleted immediately after successful video generation.

Your generated videos are stored on our servers until you delete them individually or delete your account.

10. CROSS-BORDER TRANSFERS

The Developer is based in France. Our services run on secure servers located in the United States. Accordingly, your Personal Data may be transferred to and stored in the United States. We have implemented appropriate safeguards for this data transfer, including the use of Standard Contractual Clauses (SCCs) approved by the European Commission, to ensure your personal data continues to receive an adequate level of protection.

11. CHILDREN

General age limitation: Aiwiggle is not intended for or directed at children under 13.

Age limitation for EEA residents: Due to requirements of the GDPR, you shall be at least 16 years old in order to Use Aiwiggle.

If you are a parent or guardian and believe your child has provided us with personal data, please contact us so we can take appropriate action.

12. OTHER WEBSITES AND SERVICES

We are not responsible for the practices employed by any websites or services linked to or from Aiwiggle. Our app uses Sign in with Apple for authentication, and your interaction with Apple's services is governed by Apple's privacy policy. In-app purchases are also processed by Apple through the App Store.
