Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of these Terms and Conditions:

• Developer (referred to as either "the Developer", "We", "Us" or "Our" in this Agreement) refers to the individual developer based in France.
• Country refers to: France
• Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
• Service refers to the Aiwiggle mobile application.
• Terms and Conditions (also referred as "Terms") mean these Terms and Conditions that form the entire agreement between You and the Developer regarding the use of the Service.
• Third-party Social Media Service means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service, specifically Sign in with Apple.
• Application refers to Aiwiggle, the mobile application provided by the Developer.
• Virtual Currency means the digital currency (diamonds or gems) used within the Application to generate videos.
• You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Acknowledgment

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Developer. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service.

By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service.

You represent that you are over the age required by applicable laws in your jurisdiction to use the Service. For users in the European Economic Area, you must be at least 16 years of age. For users in the United States and other regions, you must be at least 13 years of age. If you are a minor in your jurisdiction, you must have parental consent to use the Service.

Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Developer. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Application and tells You about Your privacy rights and how the law protects You. Please read Our Privacy Policy carefully before using Our Service.

AI Video Generation Service

Description of Service

Aiwiggle provides AI-powered character and video generation technology that allows users to create personalized anime-style content through the following process:

1. Select Anime Character Style: Users choose their preferred anime character aesthetic
2. Upload Photo: Users upload a personal photo to be used for character generation
3. Generate Anime Character: Our AI model processes the photo to create a personalized anime-style character based on the user's appearance
4. Proceed to Video Generation: Users can continue to create videos using their generated anime character
5. Select Video Template: Users choose from various video templates with different movements and real-world scene backgrounds
6. Generate Animated Video: Our AI model animates the user's anime character to perform actions within the selected video template

Photo Upload Guidelines

For optimal results and expected user experience:

• We recommend uploading a full-body front-facing photo
• Photos should be clear and well-lit
• You are solely responsible for the photos you upload
• You must have the right to use and upload any photo you submit to the Service

AI Generation Disclaimer

The Developer strives to provide high-quality AI-generated content. However:

• The quality and accuracy of generated characters and videos may vary based on the uploaded photo
• AI generation technology is continuously evolving and results may not always meet expectations
• The Developer does not guarantee that the generated content will be free from errors or defects
• It is possible that the AI model may generate content that you find inappropriate or undesirable

Virtual Currency

The Service uses Virtual Currency (diamonds/gems) for video generation:

• Virtual Currency is purchased through Apple App Store in-app purchases
• Each video generation consumes a specific amount of Virtual Currency
• Virtual Currency has no monetary value and cannot be exchanged for cash or transferred
• Virtual Currency purchases are non-refundable, except as required by applicable law or Apple's refund policies
• The Developer reserves the right to adjust the Virtual Currency pricing and consumption rates at any time

User Responsibilities

User Content

You are solely responsible for any photos you upload, videos you generate, and any other content that you create, transmit or display while using the Service. You represent and warrant that:

• You own or have the necessary licenses, rights, consents, and permissions to upload and use the photos
• The photos do not infringe, violate, or misappropriate any third-party right, including copyright, trademark, privacy, publicity, or other personal or proprietary rights
• The photos do not contain any illegal, harmful, or inappropriate content

Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Uploading photos of individuals without their explicit consent
• Uploading content that is illegal, offensive, discriminatory, or harmful
• Attempting to reverse engineer, decompile, or extract the AI model or any other technology from the Service
• Using the Service for any commercial purpose without our explicit written consent
• Using the Service to generate content that violates any laws or regulations
• Sharing, distributing, or selling access to the Service or generated content in violation of these Terms
• Manipulating Virtual Currency or attempting to obtain Virtual Currency through unauthorized means
• Using the Service in any way that could damage, disable, or impair the Service

Intellectual Property

Our Intellectual Property

The Service and its original content (excluding content provided by users), features, functionality, and AI models are and will remain the exclusive property of the Developer and our licensors. The Service is protected by copyright, trademark, and other laws of both France and foreign countries. You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of our software or AI models.

User Content License

By uploading photos through the Service, you grant us a limited license to process, store, and use your photos solely for the purpose of providing the Service. This license includes:

• Storing your uploaded photos temporarily on our servers for character and video generation
• Processing your photos through our AI model for character creation and video animation
• Storing your generated characters and videos for your future access within the Service

You retain all rights to your original photos, subject to the license granted herein.

AI-Generated Content

The legal status of AI-generated content, including anime characters and videos generated through the Service, varies by jurisdiction. Copyright and other intellectual property laws regarding AI-generated content are evolving and differ across countries and regions.

The Developer makes no claim, representation, or warranty regarding whether AI-generated content qualifies for copyright, trademark, or other intellectual property protection under the laws of any jurisdiction.

You are solely responsible for determining whether and to what extent your use of the AI-generated characters and videos complies with applicable laws, including but not limited to intellectual property laws. If you choose to use, distribute, or commercialize AI-generated content, you do so at your own risk and must ensure compliance with all applicable laws and regulations in your jurisdiction.

Use of Generated Content

The Developer grants you a personal, non-exclusive, non-transferable, worldwide license to use the AI-generated characters and videos created through the Service for lawful purposes. The scope of your rights to use, share, or commercialize such content may be subject to applicable laws and third-party rights.

Links to Other Services

Our Service may contain links to third-party services (specifically Apple services for authentication and payment processing) that are not owned or controlled by the Developer.

The Developer has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party services. You further acknowledge and agree that the Developer shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such services.

We strongly advise You to read the terms and conditions and privacy policies of any third-party services that You use.

Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.

Upon termination:

• Your right to use the Service will cease immediately
• Your Virtual Currency balance will be forfeited and has no cash value
• We may, but are not obligated to, delete your generated videos and account data

If you wish to terminate your account, you may do so through the Settings page within the application.

Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of the Developer and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or 100 EUR if You haven't purchased anything through the Service.

To the maximum extent permitted by applicable law, in no event shall the Developer or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Developer or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Some jurisdictions do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these jurisdictions, each party's liability will be limited to the greatest extent permitted by law.

"AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Developer, on its own behalf and on behalf of its licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice.

Without limitation to the foregoing, the Developer provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

Without limiting the foregoing, neither the Developer nor any provider makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Service, or the information, content, and materials or products included thereon; (ii) that the Service will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Service; or (iv) that the Service, its servers, the content, or e-mails sent from or on behalf of the Developer are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.

Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. But in such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.

Governing Law

The laws of France, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.

For users located in the European Union, you shall also be entitled to any mandatory provisions of the law of the country in which you are resident.

Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Developer at the email address provided below.

If a dispute is not resolved informally within thirty (30) days, either party may submit the dispute to mediation or, if mediation fails, to the competent courts of Paris, France.

For European Union (EU) Users, you also have the option to use the Online Dispute Resolution platform provided by the European Commission.

United States Legal Compliance

You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a "terrorist supporting" country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not effect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.

By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the Service.
